auto pedestrian accident

Austin, TX (8/28/2020) – A pedestrian was struck by a vehicle over the weekend and is now dead.

The accident happened in Austin on Sunday around 4 p.m. along South Lamar Boulevard. A Toyota Corolla was headed southbound and approached an intersection. A vehicle was stopped in the left turn lane at a red light and the Toyota swerved left of the car to avoid hitting it. The Toyota then went onto the center cement median and struck a pedestrian.

The pedestrian, a 31-year-old man, was killed at the scene.

The man has been charged with intoxication manslaughter.

Crash investigators will review all factors that may have led up to the accident and police reports will be made available in fourteen days.

Due to the nature of the incident, the surviving family of the pedestrian may be entitled to a wrongful death claim against the negligent driver. According to Texas law, a pedestrian has the right of way when crossing an intersection at a crosswalk. If it’s revealed that the pedestrian was on a sidewalk or on the median at the time of the collision, then they are entitled to a wrongful death claim against the driver.
