Austin, TX (1/9/2020) – A man was killed in a fatal accident while attempting to cross a busy East Austin street early Wednesday morning.
The accident happened in the 1100 block of Airport Boulevard when a man in his 60s attempted to cross said street when he was struck by a vehicle, and then hit by another vehicle.
He was pronounced dead at the scene.
Both drivers stayed behind at the scene and cooperated with authorities.
Crash investigators will review all factors that may have led up to the accident and police reports will be made available in fourteen days.
Due to the nature of the incident, and the matter of the pedestrian being struck by two different vehicles, the surviving family of the pedestrian is entitled to a wrongful death claim against the two drivers. According to Texas law, a pedestrian has the right of way when crossing an intersection at a crosswalk. It remains to be seen, however, if the pedestrian was crossing at a red or green light, since that will determine if the drivers are wholly liable an at-fault.
