After an oilfield explosion, two injured workers hired Sutliff & Stout to help. Date of Jury Verdict: June 28, 2023 | Wrongful Death Verdict

In a three-day trial in Harris County in June 2023, Sutliff & Stout represented a widow and mother, and five minor children stemming from an 18-wheeler accident that claimed the life of a 34-year-old husband/father. The insurance company argued to the Jury that with time, we all heal, and that the children had other family members that could step up to take the place of the children’s father. The insurance company also argued that the accident was the children’s father’s fault. Prior to the trial, the insurance company offered our clients $0.00. The Jury unanimously ruled in favor of our clients, awarding the surviving family members $13,314,000.00. The insurance company has indicated that it plans to appeal.

After a motorcycle accident that claimed the life of their adult son, his parent hired Sutliff & Stout to help represent them and provide answers about what had happened. Wrongful Death Arbitration Award for a Wife who lost her husband
Sutliff & Stout had the privilege of representing a woman whose husband was killed when an 18-wheeler forced another driver off of the road. The driver lost control of his vehicle and collide with our client’s husband who was on the side of the road getting his mail. The 18-wheeler driver and his insurance company refused to be fair and insisted that the other driver was at fault. Prior to arbitration, the insurance company refused to offer more than $200,000. Sutliff & Stout arbitrated the matter and helped obtain the wife and two adult children an award of $3,317,116. After the award, the parties were able to enter into a confidential settlement to resolve the matter and fairly compensate our client. The net recovery to our client, the spouse of the deceased, was $424,173.78

Wrongful Death Settlement Award on Behalf of Surviving Mother & Father of Victim
Sutliff & Stout repersented a family suffering through the loss of a child due to the negliegance of another. The family was involved in a collision with 18-wheeler. The driver of the truck unexpedectly stopped in the road, giving little time for the family to take evasive driving measures. The family colided with the rear of the trailer, which was parked in the middle lane of traffic. On behalf of our clients, we were able to secure a settlement with a net payout to our clients of $2,531,406.

Sutliff & Stout was hired to represent the Estate of a man who was killed while trying to help direct traffic after an 18-wheeler jack knifed in the road.  The only claim the Estate had available in the lawsuit was a claim for the decedent’s pain and suffering for the 10 seconds prior to his death.  Sutliff & Stout was able to obtain a settlement of $2,350,000.00 for the Estate.  The net recovery to the Estate was $1,408,055.29.

Court of Menard County, Texas
Date of Jury Verdict: February 28, 2022

Sutliff & Stout represented Omero Pecina, who was hurt when he was rear-ended by a large truck.  The company refused to accept responsibility and blamed Omero for the collision because he was following a slow moving vehicle on the road.   The nature and significance of Omero’s injuries were very much in dispute, as was the type and nature of his future care.  Defendants argued Omero’s injuries only required approximately $16,000 worth of care.  Our experts explained why Omero would need life-long care to address his injuries resulting from the collision.  Prior to trail, Defendants and their insurance company only offered $200,000 to settle the case. We tried the case and won $2,168,000.  Defendants paid the verdict less a credit for a medical bill they previously paid.  The net recovery to the client was $1,311,726.

Settlement Resulting from Failure to Yield the Right of Way
Sutliff & Stout filed a lawsuit on behalf of two men who were injured after a garbage truck failed to yield the right of way.  Neither men had surgery but both suffered from back pain after the incident.  The net recovery to the men was $721,607.91.

Negligence Case Verdict
Sutliff & Stout represented a young man who was hurt while he was trying to get into his vehicle. While opening his door in a parking lot, a careless 18-wheeler driver caught the back end of his vehicle injuring our client’s neck, back and shoulder. The extent of our client’s injuries and resulting damages was extensively litigated. Defendants took the position that our client fine and their expert testified to the same. The client’s doctors testified that our client would need life-long care to address the problems with his neck and back. Prior to trail, Defendants and their insurance company only offered $10,000 to settle the case. We tried the case and the jury awarded our client $1,372,531. The net recovery to the client was $775,937.50.

Policy Limits Settlement resulting from Car Wreck
Our client was injured when a 16 year old driver lost control of her vehicle and hit our client while he was working as a surveyor on the side of the road.  Our client suffered injuries to multiple parts of his body, but his main injury was to his arm.  After filing a lawsuit, Sutliff & Stout was able to obtain the policy limits for the driver in three months.  The net recovery to the client was $810,000.00.

Sutliff & Stout represented a mom, dad and daughter who were involved in an accident after a vehicle going to fast overturned on the roadway.  The mom suffered injuries to her shoulder and back and the husband injured his back.  The daughter was not injured but she had nightmares after the incident.  The net recovery to the clients was $379,530.16.

Sutliff & Stout was able to recovery the policy limits in a lawsuit stemming from the death of our client’s 41 year old son.  The accident took place while our client’s son was working.  The claims were for our clients pain and suffering for the loss of her son.  Net recover to client was $599,457.81.

On September 6, 2018, a mother and her daughter were returning from a doctor’s appointment. Tragically, a careless 18-wheeler driver was traveling too fast and lost control of his rig. He slid across the road and struck their car. The collision claimed the life of the mother and injured her daughter. The trucking company refused to accept responsibility for what occurred and even tried to blame the state of Texas saying that the roadway was defective. After extensive discovery, depositions and investigative work, we were able to achieve a substantial settlement on behalf of the family. Net recovery to clients was $3,901,272.09.

Sutliff & Stout client, Tony, worked as a diver on a lift boat at sea. He broke both of his ankles during a personnel transfer from the lift boat to a crew boat. The cable on the personnel basket broke and dropped the client to the deck of the lift boat. The defendant company claimed that the worker caused his own death, and the company claimed that it was not liable to the family for any damages. Settlement for Head-on Collision
Our client, Steve, was driving a large commercial vehicle when he was hit head-on by a driver who was operating his vehicle in an unsafe manner. The collision totaled his vehicle and caused him to sustains substantial injuries to his shoulders and low back. The client had to undergo two shoulder surgeries and various non-surgical treatments for his low back. After extensive litigation and discovery, Sutliff & Stout was able to resolve the matter. Truck Accident Case Settlement
Sutliff & Stout filed a lawsuit against Russell Transport, Inc. relating to a collision that occurred on July 4, 2012. As a result of the collision, our client had to have back surgery. Russell Transport, Inc. tried to blame our client for the collision, but after extensive discovery we were able to show that our client was not at fault. Using an aggressive and proactive approach to the case, we were able to successfully resolve the case for $2,300,000.00 in less than nine months. Net recovery to the client was $1,320,000.00.

Sutliff & Stout obtained a $2,075,500 settlement for Danny. Danny was a diver working on a lift boat when he broke his left leg and injured his lower back during a personnel transfer from his lift boat to a crew boat. 18-Wheeler Accident Case Settlement
Sutliff & Stout successfully resolved a significant trucking accident case where liability was hotly contested. Our client was forced off the road by an eighteen wheeler, which caused his vehicle to roll over several times. As a result of the collision, the client required a two level lumbar fusion. Given the nature of the client’s surgery, his doctor limited his work activities to light duty work and, thus, the client was unable to return to his prior employment. After 10 months of litigation involving over 20 depositions we were able to achieve a $2,000,000.00 settlement for the client. Net recovery to client was $1,091,679.30

Jury Verdict Against Exxon Mobil
Sutliff & Stout represented the family of a man, Alfredo, who was killed while in an Exxon Mobil gas station. Sutliff & Stout contended that Exxon’s failure to supervise its employees resulted in Alfredo’s death. Exxon Mobil denied any liability and employed seven lawyers and three different law firms to defend the case. In the end, the Jury rejected Exxon Mobil’s arguments and sided with Sutliff & Stout and Alfredo’s family and returned a verdict for $1,937,989.30. Exxon has appealed this verdict and it is currently pending before the Texas Supreme Court. As a result, the clients have not received any money relating to the verdict.

Settlement in Commercial Vehicle Collision
Our client was involved in a significant head-on collision. The client sustained a broken collar bone and suffered a mild traumatic brain injury form the collision. As with most mild TBIs, it was difficult for the client to understand her injury and the changes in her personality. Sutliff & Stout was able to help get her to the right doctors to treat her condition and we hired the necessary experts to help explain the prolonged and detrimental effects of a TBI. After almost a year of heavily contested litigation, we were able to obtain a substantial settlement that netted the client $871,105.00 in addition to the payment of over $117,500.00 in medical expenses.

Oil Field Injury Case Settlement
Sutliff & Stout was retained to help a worker who was injured when the trailer upon which he was leaning was struck by an 18-wheeler. The client sustained injuries to his neck and lower back. Defendants argued that the impact was not sufficient to cause the client’s injuries. After investing over $89,000.00 in the case and preparing it for trial, we were able to obtain a net recovery to the client of $861,005.00 in addition to the payment of over $144,480.98 in medical expenses.

Car Accident Settlement – $60,000 in medical bills
Our client, Frank, was injured when a vehicle up ahead attempted a U Turn in the highway. Frank’s car flipped and he was taking to the emergency room via private vehicle. Eventually Frank needed surgery on his knee along with injections and physical therapy. Sutliff & Stout immediately filed a lawsuit, served discovery, and took depositions. After a failed mediation attempt, Sutliff & Stout immediately designated experts and provided reports. The case was then resolved for $1,500,000.00. The net recovery to the client was $870,330.80.

Client injured his knee when a section of casing was rolled into his leg. The client required a full knee replacement due to the already poor condition of his knee. Defendants argued that the client’s prior knee problems were the cause of his problems. Through various depositions and other efforts, we were able to demonstrate that the client’s problems stemmed from the collision and that his prior problems were not related. Through our efforts we were able to achieve a significant settlement that netted the client $822,394.00, as well as the payment of over $48,000.00 in medical expenses

Our client was significantly injured as a result of a motor vehicle accident. But the insurance company did not believe that her injuries were real because the property damage resulting from the collision was less than $1,000.00. Our clients injuries resulted in the need for two back surgeries. Sutliff & Stout was engaged and filed a lawsuit. After over a year of litigation and right before trial, the insurance company agreed to pay $1,140,000.00. The net recovery to the client was $502,817.00 in addition to the payment of over $200,000.00 in medical expenses.

Sutliff & Stout filed a lawsuit against multiple companies relating to the death of a commercial diver who was conducting an inspection dive in the Gulf of Mexico. The defendant companies vehemently disputed any liability arguing, in part, that the worker caused his own death. After nine months of discovery and motions, Sutliff & Stout obtained a favorable $1,500,000.00 settlement on behalf of the mother of the diver. Net recovery to client was $971,731.27.

Contractual Dispute Case Settlement
Sutliff & Stout achieved a $1,153,844.00 judgment for a client in a breach of contract dispute. The client and the defendant entered into an agreement in which the defendant failed to uphold his end of the bargain. Because of this breach of contract, the client contacted Sutliff & Stout. After various motions were filed, the defendant realized that Sutliff & Stout was going to force him to live up to his end of the contract. As a result, the defendant settled just prior to trial and the client’s net recovery was $1,153,844.00.

Sutliff & Stout was engaged by a Harris County landowner, whose property was being condemned by the county. After receiving a low ball offer from the county for the land, Sutliff & Stout went to work. In exchange for a $1,000,000.00 agreed judgment and a cash payment of $750,000.00, Sutliff & Stout settled a dram shop action stemming from a single vehicle accident in Texas that occurred in December 2013. This single vehicle accident claimed the life of a mother of two small children. After 9 depositions and significant discovery, Sutliff & Stout was able to obtain this result for our clients after 8 months of litigation. Attorneys fees and expenses were $256,066.02.

Our client was rear-ended while waiting at a yield sign. Initially, the client hired a different law firm to help her, but she could not get ahold of her lawyer and they would not help her with her medical bills. She decided to hire Sutliff & Stout instead. We immediately filed suit and started to work on her case. We also helped her make financial arrangements so she could have a four level cervical fusion. We also hired a life care expert to help the jury understand what our client was going to need going forward as a result of the collision and her injuries. Jobsite Injury Case Settlement
Our client was a sub-contractor on a construction site located in Frisco, Texas. While assisting in the installation of some electrical wiring, a large metal spool fell off of a forklift and landed on our client. This incident caused our client to sustain a fractured vertebra, broken leg and broken ankle. Given the facts of the case, we felt it was necessary to file suit right away. Within a year of filing suit, Sutliff & Stout was able to obtain a policy limits settlement from the at-fault party. The net recovery to the client was $561,918.64.

Our client lost her husband in a house fire – the cause of which was unknown. After engaging fire experts who did two separate inspections, it was determined that the house did not contain fire detectors in accordance with Texas law. After filing a lawsuit against the landlord and engaging in discovery, the carrier tendered its limits. The net recovery to the client was $632,788.70.

Workplace Injury Case Settlement
Marilyn’s husband passed away in a single vehicle roll-over accident. After his death, Marilyn sought the life insurance benefits they previously paid for through his employer. Under their policy, Marilyn was entitled to receive upwards of $850,000 if her husband passed away while on the job. Using an unfair interpretation of the policy exclusions, the insurance company denied Marilyn’s claim. Marilyn hired Sutliff & Stout to help hold the insurance company accountable. The Firm immediately started working on her insurance appeal and gathering evidence to support her position. This work included collecting statements, affidavits, and other records proving that the carrier’s denial of the claim was in bad faith. Sutliff & Stout filed the appeal and 45 days later, the carrier reversed its decision and found that the full amount of benefits should be paid. Net recovery to client was $521,543.75.

Two small companies engaged Sutliff & Stout to pursue fraud and breach of contract claims related to bad business deals. After aggressive discovery and motions, Sutliff & Stout obtained a settlement of $850,000, which was the net recovery for the clients.

Sutliff & Stout settled an $820,000 tire defect case for Linda, whose husband was killed in a car accident. While numerous lawyers turned down the case due to the difficulty associated with the products liability aspect of the case, Sutliff & Stout pursued the case aggressively and confidently, obtaining a favorable result. Mark died while he was driving a truck for his employment. Mark’s death was a single vehicle accident for which his employer blamed Mark for speeding. The employer tried to convince the family of Mark to settle the case without a lawyer for $250,000.00. Instead, Mark’s family hired Sutliff & Stout, and after 4 months of litigation, we were able to get the family over three times that amount. Attorneys’ fees and expenses were $313,000.00.

Sutliff & Stout was engaged by a businessman who sold his business to a big corporation. As part of the sales agreement the big corporation owed the businessman additional money due to the business’s performance post-sale. Summary Judgement in Employer Case
Anthony was employed by a company for over a decade. As part of his employment, he was to receive commissions relating to his sales. While he did receive some commissions per his agreement with his employer, he was owed $700,000 when he was terminated for reasons relating to his demand for payment. Anthony hired Sutliff & Stout, and a lawsuit was immediately filed. After 8 months of discovery, Sutliff & Stout filed a motion for summary judgment, which was granted. As a result, Anthony obtained a Judgment finding that his former employer owes him $700,000 plus interest.

Shannon was injured as a result of materials falling off of an 18-wheeler on to her mini-van while she was at a red light. The injuries to her back required her to get a pain pump. She and her husband tried to deal with the insurance company on the front end, but insurance company refused to be fair. In fact, the insurance company refused to offer more than $15,000 to resolve Shannon’s claim. After hitting a dead end, Shannon hired Sutliff & Stout, who after a significant amount of discovery and work was able to obtain $525,000 settlement for Shannon. Net recovery to client was $316,000.

Settlement in Collision where DPS faulted our Client for the Collision
Sutliff & Stout was hired to assist the adult children of a man who passed away in a collision in West Texas. The case was difficult because DPS faulted the deceased for the collision contending that he was traveling too fast. Despite the difficulties associated with the claim, Sutliff & Stout agreed to help and retained one of the most well-respected accident reconstructionist in the state of Texas. Through these efforts, we were able to demonstrate the flaws in the conclusions made by DPS and convince the other party that it was a case that should be settled. These efforts resulted in a net recovery of $362,083.00 to our clients.
