Refugio, Texas (3/27/2020) – A man is now dead after an auto-pedestrian accident on March 24.
The accident happened around 5:00 a.m. just north of Refugio on U.S. 77 when a Kenworth semi-trailer truck traveling south struck Rayhaan Traboulay, 36. According to officials, Traboulay was standing on an improved shoulder near the driver’s side door because his car ran out of gas. That’s when he was struck.
Traboulay was pronounced dead at the scene.
Crash investigators will review all factors that may have led up to the accident and police reports will be made available in fourteen days.

Due to the nature of the incident, the surviving family of the pedestrian is entitled to a wrongful death claim against the Kenworth truck driver. According to Texas law, a pedestrian has the right of way when crossing an intersection at a crosswalk. It remains to be seen, however, if the pedestrian was crossing at a red or green light, since that will determine if the drivers are wholly liable an at-fault.
